Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Ashe Labs, a sole proprietorship based in Illinois (“Warning Track,” “we,” “us”), and govern your access to and use of the Warning Track service at warningtrack.app (the “Service”).

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By creating an account you represent that you are 18 or older.

2. The Service

Warning Track is a web application that helps recreational baseball and softball teams claim and manage their team page, build a roster, synchronize schedules from external feeds (such as TeamSideline and QuickScores), and record per-game player statistics. Features may be added, changed, or removed at any time.

3. Your account

• You must provide accurate information when you sign up.
• You are responsible for keeping your password confidential and for all activity under your account.
• You must not share your account or let anyone else use it on your behalf.
• Notify us promptly at legal@ashe-labs.com if you suspect your account has been compromised.

4. Acceptable use

You agree not to:

• Scrape, crawl, or systematically extract data from the Service.
• Attempt to access teams, rosters, or data you are not authorized to see, or to bypass our row-level security or other access controls.
• Impersonate another person or misrepresent your authority to act on behalf of a team, league, or organization — including when claiming a team as captain.
• Submit problem reports, statistics, or other content that is unlawful, harassing, defamatory, or infringes anyone’s rights.
• Interfere with or disrupt the Service, including by uploading malicious code or attempting to overload it.
• Use the Service to violate any applicable law or these Terms.

5. Your content

You retain ownership of the statistics, problem reports, and other content you submit through the Service (“Your Content”). You grant Ashe Labs a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content as necessary to operate, secure, and improve the Service. You represent that you have the right to grant this license for everything you submit.

6. Team claiming and captain duties

When you claim a team as captain, you represent that you are authorized by the team or its sponsoring organization to do so. We may revoke captain access, reassign team ownership, or suspend an account if we receive a credible report that a claim was made without authorization.

7. Schedules from third-party sources

The Service synchronizes schedules and results from third-party feeds including TeamSideline and QuickScores. We do not control those sources and do not guarantee that synced schedules, scores, or other data are accurate, complete, or up to date. Confirm important details with your league directly.

8. Pricing and paid features

The Service is currently offered free of charge. We may introduce paid tiers in the future; if we do, additional billing terms will be presented at checkout and any paid features will be governed by those additional terms.

9. Intellectual property

The Warning Track name, logo, software, and the design of the Service are owned by Ashe Labs and are protected by intellectual property laws. These Terms do not transfer any of those rights to you. All rights not expressly granted are reserved.

10. Termination

You may close your account at any time by emailing legal@ashe-labs.com. We may suspend or terminate your access to the Service at any time if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GAME SCHEDULES, SCORES, OR STATISTICS WILL BE ACCURATE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ASHE LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (a) ONE HUNDRED US DOLLARS (US$100) OR (b) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Ashe Labs from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, Your Content, or your violation of these Terms.

14. Governing law and venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute that is not resolved informally must be brought in the state or federal courts located in DuPage County, Illinois, and you consent to personal jurisdiction there.

15. Dispute resolution

Before filing a claim, you agree to first try to resolve the dispute informally by contacting us at legal@ashe-labs.com and giving us 30 days to respond. Nothing in these Terms prevents either party from seeking relief in small-claims court for qualifying disputes.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page and, for material changes, send notice to the email associated with your account. Your continued use of the Service after an update means you accept the updated Terms.
